Terms and Conditions of Sale

Article 1 – Scope

These Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded by Lunalight, operated by Désiré Olivier (the “Seller”), with consumers and non-professional buyers (the “Customer” or “Customers”) wishing to purchase the products offered for sale on the website https://lunalight.uk .

These Terms and Conditions set out in particular the conditions for ordering, payment, delivery and handling of any returns for products ordered by Customers.

These Terms and Conditions may be supplemented by specific conditions displayed on the Website prior to any transaction with the Customer.

These Terms and Conditions apply to the exclusion of any other terms and conditions.

They are accessible at any time on the Website and the version applicable to the Customer’s purchase is the version in force on the Website on the date the order is placed.

Article 2 – Products offered for sale

The products offered for sale on the Website are lighting products, including pendant lights, chandeliers and ceiling lights.

The main characteristics of the products, including specifications, illustrations and dimensions, are presented on the Website.

The Customer is required to read them before placing any order. The choice and purchase of a product are the sole responsibility of the Customer.

Photographs and visuals shown on the Website are for illustrative purposes only and are not contractually binding.

The Customer should refer to the description of each product to know its essential properties, features and estimated delivery time.

Article 3 – Availability

Product offers are valid while stocks last, as indicated at the time the order is placed.

The Customer acknowledges having the legal capacity required to enter into a contract and purchase the products offered on the Website.

Article 5 – Orders

5.1 Placing an order

It is the Customer’s responsibility to select on the Website the products they wish to order.

Before confirming the order, the Customer may review the details of the order, the total price and correct any possible errors.

An order is considered placed once the Customer accepts these Terms and Conditions and confirms the order.

The sale is only final once the Seller has sent an order confirmation email to the Customer and received full payment.

The Seller reserves the right to refuse or cancel any order in the event of a dispute relating to a previous order or payment issue.

The Seller does not sell products on the Website to professionals for resale, but only to consumers and non-professional buyers for personal use.

5.2 Modification of an order

Requests to modify an order may only be accepted if they are possible and if the request is sent by email to info@lunalight.uk before the order has been dispatched.

If the requested modification cannot be accepted, any sums already paid for the part of the order that cannot be fulfilled will be refunded.

5.3 Cancellation of an order

An order may be cancelled by the Customer before dispatch by contacting info@lunalight.uk as soon as possible.

Once an order has been dispatched, cancellation is no longer possible, but the Customer may exercise the right of withdrawal or return in accordance with the Return & Refund Policy.

Article 6 – Prices

The products are supplied at the prices in force displayed on the Website at the time the order is placed.

Prices are shown in pounds sterling (GBP) and include applicable taxes where relevant.

The prices take into account any discounts that may be granted on the Website.

The total amount payable by the Customer corresponds to the full purchase price, including any applicable delivery charges as displayed at checkout. Where free shipping is offered, this will be clearly indicated on the Website.

The Seller reserves the right to change prices at any time, but products will be invoiced based on the rates in force at the time of order confirmation.

Article 7 – Payment terms

The price is payable in full on the day the order is placed by the Customer, using secure payment methods.

Accepted payment methods are:

Payment by bank card is irrevocable except in the case of fraudulent use of the card. In such a case, the Customer may request cancellation of the payment and reimbursement of the corresponding sums.

Article 8 – Delivery

Products ordered by the Customer are delivered to the United Kingdom.

Orders are processed within 1 to 2 business days. Once dispatched, estimated transit time is 2 to 5 business days. Total estimated delivery time is 3 to 7 business days.

Delivery is made to the address provided by the Customer when placing the order on the Website.

The Customer will receive an order confirmation email and, once the order has been shipped, a shipping confirmation email including tracking information where available.

The Seller will use reasonable efforts to deliver the products within the estimated times indicated. However, delivery times are estimates only.

If the ordered products have not been delivered within 30 days after the agreed delivery date, except in cases of force majeure or where the Customer is responsible for the delay, the Customer may request cancellation of the sale and obtain a refund in accordance with applicable law.

If the delivered product is damaged, defective or not in conformity with the order, the Customer must contact the Seller as soon as possible so that an appropriate solution can be offered.

Article 9 – Transfer of ownership and risk

Ownership of the products passes to the Customer only after full payment of the price.

The risk of loss or damage passes to the Customer when the Customer, or a third party designated by the Customer, takes physical possession of the products.

Article 10 – Right of withdrawal

In accordance with applicable distance selling rules, the Customer has a legal right to withdraw from the contract within 14 days of receiving the product, without giving any reason.

In addition, Lunalight accepts returns within 30 days of delivery in accordance with its Return & Refund Policy.

To exercise the right of withdrawal or request a return, the Customer must contact info@lunalight.uk.

Returned products must be sent back in a resaleable condition, complete with any accessories supplied, and must not be used beyond what is reasonably necessary to inspect them.

We offer free return shipping.

If the withdrawal right is exercised in accordance with the law, the refund will include the price of the product and, where applicable, the cost of the standard delivery option originally paid.

Refunds are processed within 14 days of receiving the returned item, or within 14 days of receiving evidence that the item has been returned, where applicable.

Article 11 – Seller liability and legal guarantees

The products sold on the Website comply with applicable laws and are suitable for non-professional use.

The Seller remains liable for lack of conformity of the goods and for hidden defects under the conditions provided by applicable law.

If a product is found to be defective, damaged, or not as described, the Seller will offer an appropriate remedy, which may include repair, replacement or refund, depending on the circumstances and applicable legal rights.

The Seller’s liability cannot be engaged in the following cases:
- failure to comply with the laws of the country where the products are delivered, which it is the Customer’s responsibility to check
- misuse, use for professional purposes, negligence, lack of maintenance, normal wear and tear, accident or force majeure
- damage resulting from incorrect installation, improper handling, unauthorised modification or unsuitable voltage use

In any event, the Seller’s liability is limited to the replacement or refund of products found to be defective or non-compliant, except where greater liability is required by law.

Article 12 – Personal data

Personal data collected through the Website is processed in accordance with the Privacy Policy.

The data requested from the Customer is necessary for processing orders, issuing invoices, handling customer service requests and managing the commercial relationship.

The Customer has rights of access, rectification, deletion, restriction, objection and portability in accordance with applicable data protection laws.

Article 13 – Intellectual property

All content on the Website, including text, images, graphics, logos, icons and design elements, is the property of the Seller or its partners and is protected by intellectual property laws.

Any reproduction, distribution or use of this content, in whole or in part, without prior written authorisation is strictly prohibited.

Article 14 – Unforeseeability

These Terms and Conditions expressly exclude the legal regime of unforeseeability to the extent permitted by applicable law.

Article 15 – Force majeure

Neither party shall be held liable if the non-performance or delay in performance of any of its obligations results from an event of force majeure as defined by applicable law.

Article 16 – Applicable law and language

These Terms and Conditions and the sales transactions arising from them are governed by French law.

They are written in English. In the event they are translated into one or more other languages, the English version shall prevail for interpretation purposes, subject to any mandatory consumer protections that may apply.

Article 17 – Disputes

In the event of a dispute, the Customer is invited to contact the Seller first in order to seek an amicable solution.

As the Seller is established in France, customers may also use a French consumer mediation service where applicable.

Article 18 – Pre-contractual information and acceptance

Placing an order on the Website implies full acceptance by the Customer of these Terms and Conditions of Sale and the obligation to pay for the products ordered.
